These Terms of Service ("Terms") are a binding agreement between you, whether personally or on behalf of an entity ("you"), and Blink First LLC, a California limited liability company doing business as PageSumo ("PageSumo", "we", "us"), 27422 Portola Pkwy, Ste 200, Foothill Ranch, CA 92610, United States, governing your access to and use of the PageSumo service, the pages published through it, and any related websites and applications (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
By using the Service you represent and warrant that the information you provide is accurate and that you will keep it current, that you have the legal capacity to agree to these Terms, that you will not use the Service for any illegal or unauthorized purpose, and that your use will comply with all laws that apply to you.
You are responsible for all activity under your account and for keeping your password and access credentials secure. Notify us promptly at [email protected] if you believe your account has been compromised.
Your username forms part of the web address your pages are published on and cannot be changed once chosen. Some usernames are reserved.
You may authorize AI assistants and other applications to access your account. When you do, that application can view, create, modify, and delete content in your account on your behalf, and actions it takes under your authorization are treated as your own actions. Authorization does not give an application access to your password or your payment details.
You may revoke an application's access at any time from your account. Revoking access does not unpublish content that has already been published.
You are responsible for reviewing what you publish. An application acting on your instructions may misunderstand them, and the Service publishes what it is instructed to publish.
You own it. You retain all rights to the content you publish through the Service. We claim no ownership of it.
License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, publicly serve, and generate previews of your content, solely to operate and provide the Service to you. This license ends when you delete the content or close your account, except for copies retained briefly in backups and caches.
Your responsibility. You represent that you have all rights necessary to publish your content and that it does not violate any law or any third party's rights.
Content is public. Content published through the Service is publicly accessible to anyone with the link and may be indexed by search engines and automated crawlers. Any access restriction offered by the Service is a convenience and not a security control. Do not publish anything you cannot afford to have seen publicly.
Keep your own copies. The Service is not a backup service. You are responsible for maintaining your own copies of your content.
The Service, including its software, design, text, graphics, and the PageSumo name and logo, is owned by us and protected by intellectual property laws. These Terms grant you no right to use our trademarks, or to copy, modify, reverse engineer, or create derivative works from the Service.
You may not use the Service to publish, host, or distribute:
You also may not attempt to break, probe, or overload the Service, circumvent its limits or access controls, resell or provide the Service to others as your own without our written agreement, or use the Service in any way that impairs our ability to provide it to others.
We may investigate suspected violations and may remove content or suspend an account at our discretion.
You are responsible for any information collected from visitors through content you publish. You must have a lawful basis for collecting it, must disclose what you collect and why, and must honor requests from those individuals regarding their information. You must not collect payment card numbers, government identification numbers, health information, or other sensitive categories of information through the Service.
We store that information on your behalf and do not use it for our own purposes.
You may connect a domain that you control, and you represent that you have the right to use it. We may cease serving a domain if we receive a credible report that you do not control it.
Plans carry limits on how much you can publish, how many domains you can connect, and which features are available. Current limits and features are shown in the Service. Content published on a free plan carries a small PageSumo mark.
Paid plans bill in advance on a recurring basis through our payment processor and renew automatically until cancelled. Prices are in US dollars and exclude taxes, which we may add where required. Providing a payment method authorizes recurring charges until you cancel. If a payment fails, we may retry it and may move your account to a free plan.
You may cancel at any time from your account. Cancellation takes effect at the end of the period you have already paid for, after which your account moves to a free plan.
We do not delete your content because you downgraded. If a change of plan leaves you over its limits, content over the limit is taken offline rather than deleted, and is restored automatically when you upgrade.
We may change plans, limits, and pricing. If a change affects a plan you are currently paying for, we will notify you before it takes effect and you may cancel.
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, and we do not offer a service level agreement. If we discontinue the Service or a significant part of it, we will give reasonable notice and a means to retrieve your content.
We may suspend or terminate your account or access to the Service if you violate these Terms, if your use harms other users or the Service, or if we are required to do so by law. When an account is terminated, content published under it stops being served.
Except in cases of clear abuse or where the law requires otherwise, we will tell you what happened and give you an opportunity to address it and to retrieve your content.
You may close your account at any time by emailing [email protected].
If you believe content published through the Service infringes your copyright, email [email protected] with enough information to identify the work, the address of the content, your contact information, and a statement that you believe in good faith the use is not authorized. We remove infringing content and terminate the accounts of repeat infringers.
The Service works with services operated by other companies, and content published through it may link to third-party websites. Those services and websites are governed by their own terms and privacy policies. We do not control them and are not responsible for them.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CONTENT WILL BE PRESERVED WITHOUT LOSS.
TO THE FULLEST EXTENT PERMITTED BY LAW, PAGESUMO AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to defend, indemnify, and hold harmless PageSumo and its operators from any claim, demand, loss, or expense, including reasonable legal fees, arising out of the content you publish, your use of the Service, your handling of information collected through your pages, or your violation of these Terms or of any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Orange County, California, and you and PageSumo each consent to that jurisdiction and venue.
We may update these Terms. If a change is material, we will notify you by email or through the Service before it takes effect. Continuing to use the Service after that constitutes acceptance of the updated Terms. If you do not accept them, close your account.
These Terms, together with the Privacy Policy, are the entire agreement between you and PageSumo regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. These Terms create no third-party beneficiaries. Section headings are for convenience only.
